Federal Lawsuit Filed Against Janet Napolitano Over Homeland Security’s Rightwing Extremism Policy

ANN ARBOR, MI – The Thomas More Law Center, a national public interest law firm based in Ann Arbor, Michigan, announced today that it has filed a federal lawsuit against Homeland Security Secretary Janet Napolitano. The lawsuit claims that her Department’s “Rightwing Extremism Policy, ” as reflected in the recently publicized Intelligence Assessment, “Rightwing Extremism: Current Economic and Political Climate Fueling Resurgence in Radicalization and Recruitment, ” violates the civil liberties of combat veterans as well as American citizens by targeting them for disfavored treatment on account of the political beliefs.

CONGRESSMAN DEMANDS INVESTIGATION OF SECRETARY NAPOLITANO’S CONTROVERSIAL REPORT

Michigan’s US Representative Pete Hoekstra, the top Republican on the House Intelligence Committee, today asked the Director of National Intelligence ombudsman to investigate the Department of Homeland Security’s Office of Intelligence and Analysis report on “right-wing extremism” for evidence of unsubstantiated conclusions and political bias.



The confidential memorandum/report states that the election of America’s first black president and the return of a few disgruntled war veterans could swell the ranks of “white-power militias.”

An addendum attached to the report by DHS’s Intelligence and Analysis Office defines “right-wing extremism in the United States” as including not just racist or hate groups, but also groups that reject federal authority in favor of state or local authority.

“It may include groups and individuals that are dedicated to a single-issue, such as opposition to abortion or immigration,” the memo states.

The House Intelligence Committee is responsible for authorizing funding for DHS Intelligence and Analysis and conducting oversight of the office. Hoekstra sent his letter to Homeland Security Secretary Janet Napolitano and copied Director of National Intelligence Dennis Blair. The DNI Ombudsman’s office is responsible for reviewing concerns about the quality and potential politicization of intelligence analysis.

Hoekstra was dismayed by the report’s sweeping generalizations about returning combat veterans and the suggestion that they would be susceptible to joining violent extremist groups. Hoekstra, who has sponsored a Constitutional Amendment to protect the rights of parents to raise their children, was also disappointed by the report’s assertion without substantiation that unemployed parents may foster “rightwing extremist” beliefs in their children.

“Beyond apologizing for its obviously offensive references, the administration needs to get to the bottom of how and why a report like this was written, and put standards in place to keep it from happening again,” Hoekstra said.

“This report has significant analytic shortcomings and does not deserve to be called an intelligence product,” Hoekstra said. “Our nation’s veterans and hardworking families that may be facing tough times should not be viewed as a threat and neither should citizens who oppose out-of-control federal spending and tax hikes.”



DHS Secretary Napolitano eventually did release a half-hearted apology to the American Legion, whose officials took exception to the tone of her document regarding military.

How do you sue an agency for discussing something or for someone in the agency making an assessment/suggestion that was worded poorly/politically slanted. What kind of damages are they seeking? Who was actually violated?

This is why we have politicians, to check each other out.. congressman Hoekstra seems like he's got that covered. These bs lawsuits do nothing but show desperation type anger, like the obama birth certificate ones that keep getting thrown out after the birth certificate is shown to them, and they file another one claiming it was fake.. and just waste govt resources.

if i recall i only heard him for a couple minutes while i drove between my offices.. but from my understanding he is saying it violates the 1st and 5th amendments??? i believe he has requested based on freedom of information act exactly who is on the "list" of people and is asking for the "classified" documents to be unclassified. i the link at the bottom is a copy of the actual suit. didnt really have time to look into it further

I wonder if Savage favors revealing everyone on the antiterror list who lives in the US that isn't considered "right wing". He uses the term right wing throughout the whole complaint which tells me he wants extra special rights for right wingers.

well wouldnt you say there is a major difference between going after "terror suspects" then going after citizens for political preference?

defining a target as "right wing" is purely going after a group solely because of political view or off position. going after terror suspects isnt going against the left is it? i would imagine if bush was in office and the same kind of article came out saying. DHS targets loony left? i would think james would be jumping for joy and throwing a xmas party in april and the left would be up in arms..

this is one place I agree. Everyone's named should be released. But what he is doing is still great work.

I'll take my chances telling the neighbors to any terrorists and letting them hang'em high. But I ain't in charge so who cares.

actually if liberals were targeted or the looney left was generalized by the bush administartion as say college proffesors, union officials, and artists.. id be just as outraged ..if i support the second amendment im damn well gonna support the first amendment ..whats the point in having a free democratic country?? is this fucking russia?? ..now if you name extremist groups publicly who have committed violence in the past like bill ayers weather underground or timothy mcveighs group specifically ..i dont consider them liberal or looney left or right wingers ..they are terrorists

since mcveigh and ayers how many have we had in america? that used violence and tried killing people??..

Secondly whats really right wing when it comes to vets, opposing illegal immigration and being pro life .. now usually people who support all 3 would be considered the the right ..yet the overwhelming majority of american oppose illegal immigration .. pro life democrats also exist ..as for the miltary?? i mean come on this is insane ...BENNY this is why they are called the looney left ..this report was issued to agitate the right wingers and create division .. why else would you include iraqi vets of all people??? ...they knew a reaction would come and there testing the waters ..that was done on purpose .. if it wasnt barry would have demanded janets resignation

nobody said his birth certificate is fake cause nobody has seen the orginal .. there are 2 types a "live certificate of birth" ..can be used in place of the longer original form actually called "birth certificate" .. the reason why people want answers is very simple .. the date on his live certificate is 3 days after he was born ..it became a bigger issue because Obama will not provide it .. but get this he doesnt even have to release his long form "birth certificate" to end this issue all he has to do is clear up the inconsistencies made by his own family in kenya and his sister ..how you may ask can he put this to bed without releasing it ?? very simple jst issue a press release naming the hospital where he was born and its over

the "birth certificate" is similar to a death certificate ..it will provide the time, date, hospital, he was born with a doctors signature ... The only person making this a big issue is Obama ..but considering how he allways goes after his critics i notice he hasnt said shit about WND who are the most aggressive on covering this story ..as well as the people who are filing these lawsuits ..if he was born in hawaii his refusal of naming the hospital he was born in seems like he encouraging these suits

all people want is the hospital name and this case is over .. he doesnt need to release his long form to shut up those who are suspicous

james isnt it funny that the ones who was originally against the patriot act were against it because of it being used against the citizens of this country. and now the ones who were against it for that reason are the ones who are using it against the citizens of this country??

they were never against the patriot act .. they were against Bush creating it to stop the 17 attacks he prevented here by muslim jihadists .. as well as the a planned attack on barcelona and england

if they knew it would be used against right leaning americans they would be defending it as they are now
